Privacy Policy

1. Introduction
Benies.ai ("we," "us," or "our") is a live commerce platform operated by Promotext Services LLC. This Privacy Policy explains how we collect, use, disclose, and protect information about you when you use our website at benies.ai and any related services (collectively, the "Platform"). By using the Platform you agree to the practices described in this policy. If you do not agree, please discontinue use of the Platform.
2. Information We Collect
We collect information you provide directly, information generated automatically when you use the Platform, and information from third-party services you connect to your account.
Account & Profile Information
When you register as a buyer or venue partner, we collect your name, email address, and password (stored as a one-way hash). Venue partners also provide their business name, business category, city, and contact details as part of the application process.
Transaction & Payment Information
When you place a bid, win an auction, or pay a venue membership fee, payment is processed by Stripe. We do not store full card numbers or CVV codes on our servers. We retain a Stripe Customer ID and the last four digits of your card solely to facilitate future transactions and display your saved payment method.
Preferences & Interests
If you complete the "What do you love?" onboarding flow, we store your selected experience categories in your account so we can surface relevant auctions and send you opt-in notifications.
Usage & Device Information
We automatically collect information about how you interact with the Platform, including pages visited, auctions viewed, bids placed, browser type, device type, operating system, IP address, and referring URLs. This data is used for analytics, security monitoring, and improving the Platform.
Video & Audio
Live auction streams are transmitted through Daily.co. We do not record or store video or audio streams on our servers. Please review Daily.co's privacy policy for information on how they handle stream data.
3. How We Use Your Information
We use the information we collect to:
- Create and manage your account and authenticate your identity.
- Process bids, auction wins, payments, and bookings.
- Send transactional emails such as booking confirmations, auction reminders, and password-reset instructions.
- Notify you of new live auctions in your preferred categories (only if you have opted in by saving preferences).
- Operate, maintain, and improve the Platform, including debugging and performance monitoring.
- Detect, investigate, and prevent fraudulent transactions and other illegal activities.
- Comply with applicable legal obligations.
4. We Do Not Sell Your Data
We do not sell, rent, trade, or otherwise transfer your personal information or your company's information to third parties for their own marketing or commercial purposes. Your data is used solely to operate the Platform and provide services to you.
5. Third-Party Services
To deliver the Platform, we integrate with the following third-party service providers. Each provider processes data under their own privacy policy, which we encourage you to review.
Stripe
Payment processing for auction wins and venue membership fees. Stripe collects and stores payment card details on our behalf under PCI-DSS compliance. stripe.com/privacy
Daily.co
Real-time video streaming for live auction broadcasts. Daily.co handles all video and audio transmission. daily.co/privacy
Resend
Transactional email delivery (booking confirmations, reminders, venue notifications). Resend processes your email address to deliver messages on our behalf. resend.com/privacy
Manus OAuth
Optional single-sign-on authentication for buyer accounts. If you choose to sign in via Manus, your authentication is handled by Manus's identity service. We receive only a unique identifier and your display name.
6. Cookies & Local Storage
We use session cookies to keep you signed in and to maintain your auction-room state. We also use browser local storage to remember UI preferences (such as whether you have completed the onboarding flow). We do not use advertising cookies or cross-site tracking cookies. You may disable cookies in your browser settings, but doing so may prevent certain features from working correctly.
7. Data Retention
We retain your account information for as long as your account is active or as needed to provide services. Bid history and booking records are retained for a minimum of seven years to comply with financial recordkeeping obligations. You may request deletion of your account at any time by contacting us at [email protected]. Deletion requests will be processed within 30 days, subject to legal retention requirements.
8. Data Security
We implement industry-standard security measures including HTTPS encryption for all data in transit, hashed password storage, and access controls limiting who can access production systems. No method of transmission over the internet is 100% secure. We encourage you to use a strong, unique password and to contact us immediately if you suspect unauthorized access to your account.
9. Children's Privacy
The Platform is intended for users who are 18 years of age or older. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will delete it promptly.
10. Your Rights
Depending on your jurisdiction, you may have the right to access, correct, or delete your personal information, to restrict or object to certain processing, and to data portability. To exercise any of these rights, please contact us at [email protected]. We will respond within 30 days.
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect and the right to opt out of the sale of personal information. As stated in Section 4, we do not sell personal information.
11. Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you by email or by a prominent notice on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the updated policy.
